TERMS & CONDITIONS.




By placing an order with Cambrian Railway Engineering Limited you are agreeing to our terms and conditions as set out below. Please read them carefully. Updated on 30th May 2023 . We hold the right to update these terms and conditions at any time and on any review the date that they become effective will be shown as above.



Payment


We accept secure online payments via PayPal. 


Paying with your debit card through PayPal is safer than just using your debit card.   


If you do not have a PayPal account and do not wish to create a PayPal account, we also offer

Guest Checkout, using a debit or credit card within PayPal, without the need for a PayPal account login.


All confidential information is automatically encrypted once it is entered into the platform.  PayPal stores any and all financial data in secure databases.  As a customer  no payment details are shared with us, and we can not view any of your financial data, your card details will be protected during and after your payment




Placing an order


When we receive your order, you will be sent a confirmation email with your shipping and item details for you to check. 


Please make sure that the address details provided to us are up to date and correct.


We will dispatch to the address you specify upon checkout and cannot post to any other address than this.  If items are returned to us due to non receipt due to incorrect dispatch information then we will have to charge a resending fee.




Processing/shipping orders


We aim to dispatch all orders within 1-2 days of cleared payment. Larger quantity orders, if there is a stated lead time on the product, or during busy periods orders may take longer. For time scales on delivery and delivery services used and for all other delivery information please see our Shipping Information page.




Order updates


We will send you an email to inform you that your order has been dispatched and provide relevant tracking information. We will also email you if there is a query or issue regarding your order or to let you know that your order, for any reason, is going to be delayed, so please check your emails for any order updates. We cannot be responsible for you not checking your emails which contain information that may effect the delivery/processing time of your order.




Cancelling your order (Seller)


We reserve the right to cancel any order for any reason. If you select the wrong delivery method on checkout (i.e you select a UK postage service when the delivery address is not in the UK) we may cancel your order and you will need to reorder. Any order placed is not deemed to be fully accepted until it has been marked as dispatched.




Cancelling your order (Buyer)


 We want you to be satisfied with your order and you can buy from us with confidence, but on occasions there may be a reason for wanting to cancel your order. If you do want to cancel your order let us know as soon as possible.  If we dispatch your order before you request a cancellation, you will have to return the item to us for a refund.

 (Please see refunds section below) We DO NOT accept refunds on 'custom designed' orders - Please see Refunds and Exchanges.



Warranty


All UK products have the statutory 12 month warranty


Cambrian Railway Engineering warrants that on delivery and for a period of 12 months from the date of delivery, our products will conform in all material respects with their description, be of satisfactory quality and be free from material defects in design, material and workmanship.



In the rare event you are not happy with your purchase please contact us via email within 7 days. We will endeavour to rectify any issues you have either through refund or exchange.
Your right to return goods are protected under the UK Consumer Contracts Regulations 2014. 



In the event of a return being authorised as a faulty product return shipping costs will be refunded upon return and if requested a replacement item will be shipped . In the event of a return for other reasons where the product is not faulty shipping costs refunds will be at the discretion of Cambrian Railway Engineering Limited . (See Refunds and Exchanges section).


Returns


Always contact us before returning an item either by cancellation form or by email to sales@cambrianrail.co.uk.


If returning an item, enclose a copy of the receipt and contact details.  If within 14 days of receipt, under Consumer Contracts Regulations, we can only offer a product refund if the item is returned to us in an, as new, unused, condition and is saleable once checked by us.



Refunds and Exchanges


 1)

  • We can refund and exchange unused  items as long as we receive them back unused and in the original packaging.
  • If you purchase the wrong item by accident and want to exchange then there will be a fair re-posting fee that simply covers the cost of posting the new item. These charges will vary depending on the items size and where it is being posted. We will advise you what the charge is at that time.
  • Please ensure the correct gauge is selected for your product prior to submitting your order.
  • Please contact us within 6 weeks of ordering to start a return or exchange. Refunds/exchanges or 'item not received' claims will not be accepted after this time.
  • The 'Buyer' is responsible for paying the return postage costs. Please retain a Proof of Postage receipt from your postage provider, as you are responsible for making a claim in the event of the item being lost when being returned to us.
  • Your return must be accompanied by either a pre-return email and/or a message left inside the parcel. Fully stating your order details and reason for return. We will not process refunds or replacements if we do not know why the item is being returned to us.
  • Once your item is received back we will refund your original payment less the original postage fee or process your exchange and contact you for a re-posting fee if applicable.
  • If your item is returned to us due to 'non receipt/or non collection' then we will, without exception, charge an additional postage fee to resend it. It is 'your' responsibility to keep track of your order and if your item has not arrived by '3 weeks' from receiving your dispatch notice to contact us for an update/advise on locating your order. We do not provide refunds for items that are returned due to non receipt/or non collection.
  • Please make sure your address details are up to date and correct at the time of ordering.

2) In the unlikely event that you receive an item that is damaged please let us know. We may require more supporting information/evidence. 
 
3) We cannot offer a refund on custom made/designed products unless deemed faulty or damaged during delivery (with supporting evidence from the courier) as they are bespoke designs that are specially made to order. We will have clarified all the the design information with you via email before purchase so you are responsible for making sure it is suitable for your needs before payment.


4) We cannot offer a refund or exchange if a defect arises as a result of Cambrian Railway Engineering Limited following any specification supplied by the customer or if the customer alters or repairs products without our written consent.


5) We work hard to source and secure our stock therefore we do not sell to other traders unknowingly and reserve the right to cancel and refund orders where we think wholesale purchasing is taking place without our knowledge.

Missing items policy


Sometimes mail gets lost or delayed though this is rare. In this instance: 

UK CUSTOMERS - If UK items have not arrived by 15 working days (Excluding Sundays and Bank Holidays) of the dispatch date then please let us know and we will be happy to assist. 

EU ORDERS - If EU items have not arrived by 25 days (Excluding Sundays and Bank Holidays) of the dispatch date then please let us know and we will be happy to assist. 

USA/REST OF WORLD ORDERS - If these items have not arrived by 30 days (Excluding Sundays and Bank Holidays) of the dispatch date then please let us know and we will be happy to assist. 

 
We are unable to refund or exchange items before these time scales have elapsed.

For both UK and overseas customers is advisable to check with neighbours and your local mail sorting office or depot to see if they are holding the item for you. If your item is returned to us due to non receipt then we will charge an additional postage fee to resend it.




Items not received claims

 
Item not received claims made after 6 weeks from dispatch cannot be considered. We deem 6 weeks ample for you to contact us to make us aware that the order has not been received.


Tracked items states delivered but customer claims non receipt

If a tracked item has been sent and the tracking states that the item has been delivered then we must go by the tracking status. We can not resend or refund orders where the tracking states 'delivered' but the customer claims the item was not received. 




Use of your product from us


We have enclosed a Cambrian Railway Engineering Limited Owners Handbook on how to best use and care for your product.  We do not accept responsibility for products that have not been used or cared for correctly or have been damaged by improper use.  We cannot refund or exchange products for reasons of general wear and tear. Please take all reasonable care when unpacking your products, using your products, maintaining and storing your products.




Bespoke Products


Where we have designed a bespoke product to a clients brief. We reserve the right to use any bespoke designs to sell and use in the future in any manner we feel appropriate, unless the client has requested and we have agreed to grant sole rights of the design to the client upon ordering.




Overseas orders


We are a UK based business and it is the responsibility of the purchaser to pay any import tax that is due on items ordered.




Copyright


All of our products are protected by international copyright law. We allow our products to be used for personal use and for commercial use. Please do not attempt to copy our designs. We take this very seriously and regularly check online for any such infringements. Any individual or business blatantly copying our designs and passing them off as their own will have breached copyright laws and may face possible prosecution.


You may not frame this website.

You will give this website accurate information.

We or any of our hyperlinks in the future to other third party licensors own all rights in this website.

All our trade marks are our property and you may not use them without our permission.

You may not change, reverse engineer hire out or copy any of this website without our permission.




Privacy


We take your privacy very seriously and will never share any of your information with anyone else. 

We will use your name and address details provided to us in order to process and dispatch your order.  We use PayPal to take payment at checkout but we do not see, receive or store any of your card information.  We will use your email address to keep you up to date with the status of your order and only contact you in relation to your purchase if necessary.  Please view our Privacy Policy here
